Your statutory rights as a consumer are not affected. Quality Internet and Mattress Sales reserves the right to change these terms and conditions from time to time without notice to you and any changes will take effect on the day they are posted. Any such changes will be posted on this section of the website and your continued use of the website constitutes your agreement to be bound by the prevailing terms and conditions. 1. Creating the Contract 1.1 You place an order on the website by selecting an item and following the instructions. You will have an opportunity to check and correct any input error in your order up until you submit the order. 1.2 After you have submitted your order you will receive an order acknowledgement e-mail from us. This e-mail is an acknowledgement of order and not acceptance of your order. Please ensure you input a valid email address when inputting your order details. 1.3 When you are pay by credit card, we will authorise your debit or credit card payment at the time of order. If you are paying by cheque, we will deposit your cheque on the first working day after we receive it. All cheques must clear before any gods are dispatched by the Company. 1.4 Once payment has been authorised, or cleared, and we have confirmed the stock position, we will arrange for the delivery of the goods to you. Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you a second e-mail which contains the details of how your goods will be delivered to you. 1.5 We reserve the right to decline all or part of any order for whatsoever reason and should this occur we will e-mail you with these details. Any monies taken will be fully refunded by the means it was paid should we decline an order. Please allow 5 working days for refunds to clear. 1.6 The details of your contract are securely held on file by us. PAYMENT POLICY 2.1 All payments must be in full prior to an order is accepted by the Company. We do not take part deposits on orders, regardless of delivery times. 2.2 If you have chosen to pay by card, once your order is received we will process the payment for your order by way of the credit or debit card details you have provided via our secure card processor, Protx. In the event that there is insufficient stock to satisfy your order you will be informed as soon as possible. A refund will be processed through your chosen credit or debit card used for the payment of the order. Please allow 5 working days for refunds to reach your bank account. 2.3 If you have chosen to pay by cheque, full payment must be received before an order is accepted. Should you wish to pay by cheque, please contact us first to gain address details for sending payment to. Once the cheque has been cleared for payment, we will begin processing your order. In the event that there is insufficient stock to satisfy your order you will be informed as soon as possible. A refund will be made by cheque from us to you. 2.4 We will advise you if your payment details cannot be authorized for any reason or if your cheque has failed to clear. We may then invite you to pay by another method. 2.5 All prices and charges on this website are quoted in UK pounds. The price you pay for your order is that price which is displayed on the website. All prices include VAT. Delivery charges apply to certain products and certain geographical areas as specified and are calculated as part of the checkout process. If we find an error in the price of goods you have ordered we will inform you as soon as possible and give you an option of reconfirming your order at the correct price, or cancelling the order. If we are unable to contact you we will treat the order as cancelled and you will receive a full refund. 3. SECURITY 3.1 All credit and debit card payments that are made on our website are protected by a secure connection. This secure connection ensures that your credit and debit card is encrypted prior to it being transferred to the bank for authorisation. We use Protx for all card payment transactions. 3.2 As an additional security means, no credit or debit card details submitted online are stored directly by us once your order has been processed. 4. DELIVERY 4.1 We will deliver the goods you have ordered only to the address you give us for delivery at the time you place your order. Only addresses within mainland England and Wales qualify for our "Free Delivery" promotion . For the Scottish Mainland and off shore locations, including the Isle of Wight, additional charges will apply. Prices for non standard delivery areas are specified at checkout and are calculated based on your postcode. We do not deliver to Channel Islands, Isle of Man, Scottish Islands or the Republic of Ireland. Northern Ireland areas carry and additional charge as specified at checkout. 4.2 For items available for next day delivery, next day constitutes the next working day and excludes weekends and public and bank holidays. In order to receive your order on the next day, orders must be placed by 2.00pm the day before. 4.3 Whilst we aim to deliver all products on the next working day, we cannot guarantee delivery on the next working day and any date quoted for delivery of the products is approximate only. Further, we shall not be liable for any loss suffered by you arising from any delay in the delivery of the product/s. 4.4 Saturday AM delivery can be arranged at an additional cost. Please contact us should you require Saturday delivery for any of our products. 4.2 We aim to deliver your order within the time scales quoted on our website when you place your order. If circumstances change, we will contact you. If, however, it is delayed due to circumstances beyond our control, then we cannot accept any liability for any consequential loss. 4.3 All items ordered that are not from our stock are specially ordered from the specified manufacturer. The delivery times quoted are for guide only. Once we take stock of your order from the manufacturer we will contact you by phone or email to arrange a suitable delivery date to your specified address. 4.4 You will become the owner of the goods (and be liable for the loss or destruction of the goods) at the time of delivery, provided that we have received payment in full for the goods. 4.5 Delivery is generally carried out by national carrier and their experienced delivery drivers, who will deliver your new products to the most easily accessible ground floor door to your premises. Please note that if you live in a block of flats or in a basement premises, your product/s will only be delivered to the most easily accessible ground floor door of the building, and will not be delivered to your specific door of your premises within the building or basement. Please also note that national carrier personnel cannot and will not enter any your premises or any building leading to your premises, assemble your new products or dispose of your old products. 4.6 Our carriers will not unwrap any items. They cannot and will not remove or dispose of any packaging, old beds, bedding or furniture and this liability lies with you. 4.6 All deliveries are signed for. If you are out when our delivery team arrives, they will leave a card with a contact number for you to call them and arrange a delivery at a future date. Please note that there may be an additional charge for this. 5. ACCESS TO DESTINATION ADDRESS 5.1 Before placing an order, please check that the items of furniture will fit through any passages, stairwells, landings and doorways on the way to the destination room. 5.2 As part of the checkout process, you will be requested to confirm that you have checked access thoroughly. 6. CANCELLATION AND RETURN POLICY 6.1 You are required to inspect your order/s on delivery and if you find your products to be faulty or damaged and within 24 hours of receipt you must report the alleged fault or damage, then we will either exchange the product/s or issue a full refund within 14 days of delivery. In these events, provided that the product/s are adequately wrapped, we will meet all delivery and return costs. This does not affect your statutory rights. 6.2 If you are unhappy with your purchase for any other reason, or change your mind, and notify us within 7 working days of delivery, we will offer you a choice of either replacement product/s or cancellation and refund of the product/s. For hygene reasons mattresses, pillows and duvets that have been open or used will not be accepted back unless faulty. 6.3 On replacements and cancellations we reserve our right to and will seek to recover the cost of return, which would be deducted from the refund amount or added to any upgrade. We can arrange collection of unwanted product/s at the following charge Single sized mattress or bed (2’6"/3’) £45.00 per item Double sized mattress or bed (4’/4’6") £50.00 per item King sized and super king sized mattress or bed (5’/5’3"/5’6"/6’) £60.00 per item. 6.4 You are welcome to make arrangements at your expense for the carriage and the return of the product/s to us. Please ensure that all items to be returned are wrapped well and in their original wrappings. Product/s will remain the responsibility of you until they are received by us, following which we will refund payment, provided always that the product/s are received by us undamaged and in their original condition. Please contact us for return address details. 6.5 We recommend you keep all original packaging and wrapping in case a return is required. 7. CANCELLATION BY THE COMPANY 7.1 We reserve the right not to accept any order request if: 7.1.1 we have insufficient stock to deliver the goods you have ordered; 7.1.2 we do not deliver to your area; 7.1.3 one or more of the goods ordered was incorrectly described or priced on the website; 7.1.4 the payment transaction is not authorised; or 7.2 If we do cancel your contract we will notify you by e-mail and will refund to you any sum paid by you to us in respect of the contract as soon as possible, and in any event within 14 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered. 8. STOCK 8.1 As far as reasonably possible all products featured to buy on the website are either in stock and available at the time of ordering, or are produced to order with the anticipated lead-time published on site 9. UNFORSEEN CIRCUMSTANCES 9.1 While every effort is made to meet our customers’ demands, cancellations or variations may be necessary as a result of an Act of God, war, strike, lockout, labour dispute, fire, flood, drought, or other causes beyond our reasonable control. 10. CONTRACTUAL RIGHTS 10.1 In order to be eligible to enter into a contract with us to purchase goods through the website you must:- 10.1.1 provide the required information including your real name, payment details including your card address; your delivery address if different from your card address; e-mail address and telephone number; 10.1.2 be over the age of 18. 11. LAW 11.1 These terms and conditions shall be governed by and construed in accordance with English law and you hereby agree to be subject to the jurisdiction of the Courts of England and Wales. AGREEMENT 13.1 These terms and conditions together with our current website prices, delivery details, contact details and Privacy Policy set out the whole of our agreement relating to the supply of goods to you by us. 13.2 Nothing said by any salesperson on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. 13.3 Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. 14. GUARANTEES 14.1 All our products carry the manufacturers guarantees and warranties. Our products have a minimum of a 1 year guarantee from date of purchase. Some items have longer but this would be clearly stated on product description. This is a manufacturing guarantee and does not allow for normal wear and tear.
